Description
A Motor Vehicle Ownership Surety Bond (also know as a Lost Title Bond or Defective Title Bond) may be required by the CA DMV when evidence of vehicle ownership is not available. According to CA DMV Section 24 of 38 Chapter 23, ONE or more of the following conditions must also be met:
- Vehicle is nontransferable.
- Release from a legal owner and/or lienholder cannot be obtained.
- Vehicle Value is $5,000 or more.
- Vessel Value is $2,000 or more.
Please be advised that the Motor Vehicle Ownership Surety Bond is not insurance. By filing the bond with the DMV, the owner is assuming financial responsibility for the vehicle. The owner/principal may be responsible for reimbursing any claims on the Bond.

WHEREAS, the provisions of Sections 4157 and/or 4307 of the Vehicle Code require that the Principal file or have on
file with the Department of Motor Vehicles a bond in the penal sum of $ ___________________ which is the fair market
value of the motor vehicle and is executed and tendered in accordance therewith.
NOW THEREFORE, the conditions of the foregoing obligation are identified in Section 4157 and/or 4307 of the Vehicle
Code and Article 3, Section 152.00, Division 1, Chapter 1, of Title 13 of the California Code of Regulations and apply to

PROVIDED HOWEVER, this bond is issued subject to the following express conditions:
(1) This bond shall remain in full force and effect for all liabilities incurred before, and for acts, omissions, or causes
existing or which arose before, the cancellation or withdrawal.
(2) This bond is executed by the Surety to comply with Sections 4157 and/or 4307 of the Vehicle Code and chapter 2,
title 14, part 2 of the Code of Civil Procedure and said bond shall be subject to all of the terms and provisions
thereof.
(3) The aggregate liability of the Surety hereunder on all claims whatsoever shall not exceed the penal sum of this
bond in any event.
(4) This bond may be cancelled by the Surety in accordance with article 13, (commencing with section 996.310) chapter
2, title 14, part 2, of the Code of Civil Procedure. A notice of cancellation or withdrawal shall be received by DMV
in writing at least thirty days prior to the effective date and mailed to the department addressed with the unit
name and address at the top of this form. The bond remains effective in accordance with Vehicle Code section
4158.
(5) The Surety, its successors and assigns, agree they are jointly and severally liable on the obligations of the bond,
the provisions of chapter 2 (commencing with section 995.010) title 14, part 2, of the Code of Civil Procedure, and
Sections 4157 and/or 4307 of the Vehicle Code.
(6) The Principal and Surety may be served with notices, papers and other documents under chapter 2 (commencing
with section 995.010) title 14, part 2, of the Code of Civil Procedure at the addresses given above.

Principal Name and any “Doing Business As” DBA Names
When the principal is:
A sole owner; list the true full name of that person and any DBA name(s).
A partnership; list the true full name of each partner and any DBA name(s).
A limited liability partnership or limited liability company; list the true full name of the limited liability partnership
or company and any DBA name(s).
A corporation; list the true full name of the corporation and any DBA name(s) as filed with and the registration
number assigned by the California Secretary of State.
An association; list the true full name of the association and any DBA name(s).
A surety bond is only valid when it is issued to the true full name of the person(s) or entity applying for a California
motor vehicle certificate of title. When the name of the principal is the same as the DBA name, only list the
principal’s name.
